Terms of Service

Website, Services, Recurring Billing & Messaging Terms

Effective Date: October 3, 2026 · Last updated: October 12, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of Veteran Webworks websites and services, including website design and development, Website Care, local-growth and Google Business Profile services, automation, AI front-office services, communications, and related consulting (collectively, the "Services"). By purchasing Services, signing or accepting a proposal or scope, or using the Services, you agree to these Terms.

A written proposal, scope of work, invoice, order, or service agreement may contain project-specific terms. If a project-specific written agreement directly conflicts with these Terms, the more specific written agreement controls for that engagement.

2. Services, Scope, and Published Starting Prices

Published prices are starting prices, not quotes for every project. As reflected in the Veteran Webworks FAQ, the Starter Website begins at $1,200 one-time for up to five pages. Business Website projects start at $2,500+ and Growth Website projects at $4,500+, with scope confirmed before work begins. Additional pages, integrations, complexity, add-ons, or custom work may increase the price and will be identified in the applicable scope, proposal, or invoice.

A consultation or inquiry may result in a practical recommendation, written scope, and starting price or price range. You are free to decide whether to proceed.

3. Project Start, Timing, Approvals, and Client Responsibilities

Most projects begin with a short strategy call and written scope. Start dates and completion schedules depend on project size, page count, content readiness, integrations, approvals, and how quickly required client content and approvals are provided. The applicable schedule is established in the written scope; Veteran Webworks does not promise a universal completion time.

You must provide accurate information, content, approvals, credentials, and materials reasonably needed to perform the Services, and you represent that you have the necessary rights to materials you provide. Delays in client content, approvals, access, or third-party systems may affect the schedule.

4. Website Work, Rebuilds, and Custom Packages

Not every engagement requires a full rebuild. Veteran Webworks may recommend focused improvements to sales paths, local discovery, mobile experience, or other portions of an existing site when appropriate. Custom packages may combine website, local-growth, lead automation, AI front-office, integrations, and other available service layers. The written scope controls what is included.

5. Website Care, Recurring Services, and California Automatic-Renewal Rights

Website Care plans may include hosting, SSL, backups, security and uptime monitoring, software maintenance, recovery assistance, content changes, performance checks, and support depending on the selected service level. Only features stated in the applicable plan, proposal, or agreement are included.

For any automatic-renewal or continuous-service arrangement offered to a California consumer, Veteran Webworks will present the material renewal terms clearly and conspicuously before obtaining billing information, obtain the consumer's express affirmative consent to those terms, and provide an acknowledgment that can be retained and that includes the renewal terms, cancellation policy, and cancellation method, as required by applicable law.

Where California law applies, cancellation will be available through the same medium used to enroll or the medium ordinarily used to interact with Veteran Webworks. A consumer who enrolls online will be provided an online method to cancel without unnecessary obstruction or delay. Required renewal, trial-expiration, fee-change, and annual reminders will be provided within the timeframes required by applicable law.

Recurring Services continue for the applicable billing period until canceled in accordance with the applicable agreement and applicable law. Cancellation stops future renewals or recurring charges; it does not automatically refund amounts already earned or properly charged unless the applicable agreement or law provides otherwise.

Federal online negative-option transactions, where applicable, will also be handled consistently with the Restore Online Shoppers' Confidence Act (ROSCA), including disclosure of material terms, express informed consent before charging, and a simple mechanism to stop recurring charges.

6. Third-Party, Usage-Based, and Setup Charges

Third-party and usage-based charges are separate unless a written scope expressly states otherwise. These may include SMS, phone, AI, hosting, domains, software, APIs, integrations, payment processing, or similar usage or vendor charges. Applicable charges will be explained before approval so the monthly or recurring picture is clear.

AI or automation setup fees, where applicable, are shown with the selected package or written scope. Vendor pricing and terms may change independently of Veteran Webworks.

7. Local Growth, Google Business Profile, Automation, and AI

Local-growth services may include presence maintenance, Google Business Profile management, posts, review monitoring and response, reputation systems, citations, and local optimization. Lead-growth services may include contact forms, notifications, pipeline tools, booking, missed-call text-back, reminders, review requests, reactivation, and reporting, depending on scope.

AI front-office services may include chat, phone answering, FAQs, qualification, appointment requests, summaries, CRM connection, missed-call recovery, and human handoff depending on the selected package. AI systems can produce errors or incomplete outputs; clients remain responsible for reviewing material decisions, regulated communications, and information requiring professional judgment.

Our own website chat assistant and phone receptionist identify themselves as virtual (AI) assistants. How chat and calls are handled, including call recording, is described in section 7 of the Privacy Policy.

8. No Ranking, Revenue, or Business-Result Guarantees

Veteran Webworks may improve accuracy, experience, follow-up, conversion paths, profile completeness, activity, and other factors within the agreed scope, but does not guarantee Google rankings, Google Maps rankings, search visibility, traffic, leads, revenue, sales, or other business results. Outcomes depend on many factors outside any one provider's control.

9. Intellectual Property

Veteran Webworks retains ownership of its pre-existing tools, processes, templates, know-how, code libraries, systems, and other materials not created exclusively for a client. Client ownership or license rights in custom deliverables are governed by the applicable written project agreement and are subject to payment in full. Third-party software, themes, fonts, plugins, APIs, stock assets, and open-source components remain subject to their respective licenses.

10. SMS/Text Messaging Terms - TCPA and A2P

If you separately opt in to receive text messages from Veteran Webworks, you may receive messages related to inquiries, appointments, project updates, service notifications, account or billing communications, support, and - only where authorized - marketing or promotional messages.

Consent. Consent to receive marketing texts is voluntary and is not a condition of purchasing unrelated Veteran Webworks services. Consent applies to the program and sender for which it was provided. Where required by law, Veteran Webworks will obtain the level of prior express consent applicable to the type of call or text being sent.

Frequency and charges. Message frequency varies based on your relationship with Veteran Webworks, your requests, and the applicable program. Message and data rates may apply.

Revocation and opt-out. You may revoke consent by any reasonable method that clearly communicates your desire to stop covered calls or texts. For text messaging, reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. Veteran Webworks will honor valid revocation requests within the period required by federal law. A single non-marketing confirmation text may be sent to confirm the opt-out. Reply HELP for help or use the contact options at goveteranwebworks.com.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is outside Veteran Webworks' complete control.

Privacy. SMS participation is governed by the Veteran Webworks Privacy Policy at goveteranwebworks.com/privacy-policy. Veteran Webworks does not sell or share SMS opt-in data, mobile numbers, or messaging consent with third parties or affiliates for their marketing or promotional purposes.

11. Commercial Email - CAN-SPAM

Commercial email sent by Veteran Webworks will use accurate sender and routing information and non-deceptive subject lines. Where required, commercial messages will identify their commercial nature, include a valid postal address, and provide a clear method to opt out of future marketing email. Veteran Webworks will honor valid email opt-out requests within the period required by federal law. Transactional or relationship messages may continue where permitted by law.

12. Third-Party Services, Availability, Backups, and Security

Services may integrate with third-party products and platforms. Veteran Webworks does not control those parties and is not responsible for their independent acts, outages, policy changes, security practices, or content. No website, hosting environment, security service, backup system, automation, AI system, or network can be guaranteed uninterrupted, error-free, or completely secure. Unless a written agreement expressly provides otherwise, Veteran Webworks does not guarantee continuous availability, absolute security, or recovery of all data.

13. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." VETERAN WEBWORKS DISCLAIMS WARRANTIES NOT EXPRESSLY STATED IN A WRITTEN AGREEMENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VETERAN WEBWORKS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICES.

Any limitation or allocation of liability in a separately signed agreement controls where applicable. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

14. Indemnification, Suspension, and Termination

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Veteran Webworks from third-party claims arising from content or materials you provide, your unlawful or unauthorized use of the Services, or your violation of these Terms or applicable law, except to the extent caused by Veteran Webworks' own conduct for which indemnification may not lawfully be required.

Veteran Webworks may suspend or terminate Services for nonpayment, material breach, unlawful activity, security risk, abuse, or other grounds permitted by an applicable agreement or law. Provisions that by their nature should survive termination remain effective.

15. Governing Law, Consumer Rights, and Changes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law controls. Nothing in these Terms waives rights or remedies that cannot lawfully be waived under applicable consumer-protection law.

Any dispute-resolution procedure in a separately signed agreement governs that engagement to the extent enforceable. Otherwise, the parties will first attempt in good faith to resolve disputes informally.

Veteran Webworks may update these Terms from time to time. The updated version will be posted with a revised effective date. Material changes will receive additional notice where required by law.

16. Using This Website

You may use this website for lawful purposes. Do not attempt to disrupt it, probe it for weaknesses, submit false or automated form entries, or copy it in bulk. Information on the site is general information. It is not a quote, a contract, or professional advice, and published prices are starting prices as described in section 2.

We aim to make this website usable by everyone, including people who use assistive technology. If something is hard to use, email [email protected] and we will help and fix it. Our Accessibility Statement is at goveteranwebworks.com/accessibility.
